RUSSELL SQUARE ENCLOSURE

BYELAWS

made under and in pursuance of the powers contained in the Brighton Improvement Act, 1884, by the Russell Square Committee on the second day of June, 1891. As to the enclosed place in the centre of Russell Square in the Borough of Brighton.

1. In these Byelaws, the following words and expressions shall have the meanings hereinafter respectively assigned to them, unless such meanings be repugnant to, or inconsistent with the context or subject matter in which such words or expressions occur, that is to say: -

"The Committee" means the Russell Square Committee appointed under the provisions of the Brighton Improvement Act, l884.

"The Enclosure" means the enclosed place in the centre of Russell Square in the said Borough.

"An Officer of the Committee" means any officer appointed by the Committee, and includes a ground keeper and any persons or servant of a person employed by the Committee in or about any work in connection with the improvement or maintenance of the Enclosure or the preservation of order therein.

2. The Enclosure shall he open every day for the use of the persons entitled to admission thereto during such hours as the Committee may by a. notice board fixed at one of the entrances to the Enclosure from time to time appoint, and no such persons shall enter the Enclosure at any other time than during the appointed hours.

3. Every inhabitant householder entitled to admission to the Enclosure shall, on application to the Committee and depositing with them a sum of 2s/6d be supplied with a key of the gates of the enclosure engraved with the number and situation of the house of the person to whom the same is issued, which deposit shall be repaid on the key being surrendered to the Committee, and no person entitled to use the Enclosure shall use any key other than a key so supplied as aforesaid.

4. One key only at a time will be issued in respect of each house, the inhabitants of which are entitled to admission to the Enclosure, except in the event of the key first delivered to the householder being lost in which case such householder shall on application to the Committee and depositing with them a further sum of 2s/6d be supplied with a duplicate key, such deposit to be refunded on the duplicate key being surrendered.

5. No person to whom a key is issued shall lend or permit the same to be used by any person not entitled to admission to the Enclosure.

6. No person shall enter the Enclosure except by the gates, and the person unlocking either of the gates shall re-lock the same immediately after entering or passing out of the Enclosure.

7. No person entitled to admission-to the Enclosure shall wilfully or improperly remove or displace any board, plate or tablet, or any support fastening or fitting of any board plate or tablet used or constructed, or adapted to be used for the exhibition of any byelaw or notice and fixed or set up by the Committee in the Enclosure or in or on any wall or fence enclosing the same.

8. No person entitled to admission to the Enclosure shall carelessly or negligently deface, injure or destroy, or wilfully, carelessly, or negligently -soil or defile any building, seat or decoration, or any other structure or erection in the Enclosure, or any gate, barrier, wall, railing, or fence, in or enclosing the Enclosure, or wilfully, carelessly, or negligently throw or deposit, or cause or suffer to fall or to be thrown or deposited on any part of the Enclosure any animal or vegetable matter, or any bottles, glass, earthenware, filth, rubbish or refuse whatever.

9. No person entitled to admission to the Enclosure shall wilfully carelessly or negligently remove or displace any barrier, railing, or post or any fixed or movable seat, or any part of any building, structure or erection, or any ornament or decoration or any implement, utensil, apparatus, appliance, or article provided for use, or used, or adapted to be used in the improvement or maintenance of the Enclosure, or in the care, cultivation, or protection of any tree, sapling, shrub, underwood, gorse, or furze therein.

10. No person entitled to admission to the Enclosure, other than an Officer of the Committee or a person acting in pursuance of their directions in that behalf shall affix or post any bill, placard, advertisement, or notice to or upon any wall or fence in or enclosing the Enclosure, or to or upon any tree, gate or post, or to or upon any part of any building barrier, or railing, or of any fixed or movable seat, or of any other structure or erection in the Enclosure.

11. No person entitled to admission to the Enclosure, other than an Officer of the Committee shall paint, write, or in any manner inscribe letters, figures, or mark upon any wall or fence in or enclosing the Enclosure or to or upon any tree, gate or post, or upon any part of any building, barrier, railing, or seat, or any other structure or erection in the Enclosure.

12. No person entitled to admission to the Enclosure shall at any time pluck any flower, or cut, displace, uproot, set fire to or damage any tree, sapling, shrub, plant or turf, or walk or stand on or disturb the soil of any flower bed in the Enclosure.

13. No person entitled to admission to the Enclosure shall behave in the Enclosure in a disorderly or riotous manner.

14. No person entitled to admission to the Enclosure shall willfully carelessly or negligently throw or discharge any stone or other missile, or discharge any firearm or make any bonfire, or throw or set fire to any fireworks in the Enclosure.

15. No person entitled to admission to the Enclosure shall climb any gate, barrier, wall, railing, or fence in or enclosing the Enclosure or any tree or post, or any other structure or erection in the Enclosure.

16. No person entitled to admission to the Enclosure shall at any time in the Enclosure play at any game of ball or other game likely to damage the trees, shrubs, flower beds, or turf, or which may interfere with the full enjoyment of Enclosure by all persons entitled thereto.

17. No person entitled to admission to the Enclosure shall bring any dog, or cause or suffer any dog belonging to him or in his charge to enter into the Enclosure

18. No person entitled to admission to the Enclosure shall bring in to the Enclosure any bath chair, cycle or hand carriage of any kind whatsoever, provided that the Byelaw shall not be deemed to prohibit the use in the Enclosure of perambulators carrying a child or children.

19. No person entitled to admission to the Enclosure shall beat, shake, sweep, brush or cleanse any carpet, druggett, rug or mat in the Enclosure.

20. No person entitled to admission to the Enclosure shall wilfully obstruct, disturb, interrupt, or annoy, any other person in the proper use of the Enclosure, or wilfully obstruct, disturb, or interrupt any Officer of the Committee in the proper execution of his duty or in the proper execution of any work in connection with the improvement or maintenance of the Enclosure.

21. Every person who shall offend against any of the foregoing Byelaws shall be liable for every such offence to a penalty of forty shillings. Provided nonetheless that the Justices or Court before whom any any complaint may be made or any proceedings may be taken in respect of any such offence, may if they think fit, adjudge the payment as a penalty of any sum less than the full amount of the penalty imposed by this Byelaw.
