Site/Property: West Pier & Land Adjacent Kings Road Brighton

Proposal: Restoration and refurbishment of building on the west pier and provision of two new buildings for retail (Al), food and drink (A3) and leisure (D2) uses, adjacent to landside end of pier, together with provision for access and servicing (To include Application No. BH2002/00886/LB - Creation of openings in existing listed railings for pedestrian access and Application No. BH2002/00887/CA -Demolition of walls around paddling pool and petanque area. (Amended Scheme)

I have received the above Full Planning application which will in due course be decided by the Council; as an adjoining owner and/or occupier I invite you to make comments in writing not later than 16 October 2002. Please bear in mind that any representations can be disclosed to the applicant or made public in the normal course of the Council's business. The description above is a summary of the proposed development; if you wish to know more about the proposal you should contact this office or call and inspect the plans and documentation during the times given below.

I regret that this Department does not have the resources to respond to all written enquiries relating to current applications. However, the submitted plan and other information are available for inspection at the Council between 9am and 4.30pm Mondays to Fridays (at Bartholomew Square, Brighton and Norton Road, Hove). If you need assistance please come to the Hove Town Hall Information and Advice Centre, where a member of my staff will usually be on hand to help; however, on occasions you may need to make an appointment

The City Council has introduced limited public speaking rights for applications which are considered at the Planning Applications Sub-Committee. If you would like to take advantage of this opportunity please let us know when you respond to this letter, as late requests to speak cannot be accepted.

No acknowledgement can be given of the receipt of representations but if you would like to be notified of the final decision please send a stamped addressed envelope so that I can reply.

How to find out about a planning application

  • See the submitted plans and forms at the Information and Advice Centres in Hove or Brighton (see above)
  • If the application has been made by your neighbours, ask them to explain their proposals
  • If you don't understand any part of the proposals, contact the case officer (name and telephone as above)

Commenting on an application

If you have objections to an application, please inform us in writing. If officers consider that the application should be approved even though there are valid planning objections, your comments will be reported to the Planning Applications Sub-Committee, who will decide whether or not consent should be granted. Your local Councillors may be prepared to speak at the Sub-Committee meeting on your behalf, or you can attend to speak yourself. The Council can only take certain matters into account when considering your comments on a planning application.

These include whether:

  • A proposed use is suitable for the area
  • The appearance and size of a new building is in keeping with its neighbours and surroundings
  • External alterations to an existing building are in character
  • Adjoining residents will suffer overshadowing, overlooking or loss of privacy
  • There will be any increase in noise and disturbance, e.g. from the comings and goings of extra traffic
  • New buildings have satisfactory access for disabled people
  • New roadways and accesses will be safe for pedestrians and other road users
  • In the case of an application for an advertisement, the proposed sign is too large or unsightly
  • In the case of an application for listed building consent, the works are in keeping with the building.

Issues that cannot be taken into account include:

  • Loss of view
  • Boundary and other disputes between neighbours
  • Loss of trade from competing businesses
  • Loss of property value

Please note

The Council has to approve an application unless there are good planning reasons to refuse it. Conditions may be attached to an approval to cover points which may be of concern, or the applicant may be prepared to amend the plans to overcome such concerns.
